Ian Linkletter is taking his case against Proctorio to the Supreme Court, asking three key questions:

  • Is sharing a link to a video hosted on a video-sharing website copyright infringement?
  • Can it be a breach of confidence to share information that is widely available via a simple Google or YouTube search?
  • Can a lawsuit with absolutely no evidence of harm survive an anti-SLAPP application?

The answer to all three of these should, of course, be 'no', for any other answer, as Linkletter argues, changes some fundamental tenets of Canadian internet and copyright law. Anyhow, he'll need more money to take his case forward.
